Rajesh Kumar v. State of Himachal Pradesh: Is to Err Justice?

Absolute justice is not possible in any judicial system since judges are also humans, making them susceptible to make errors. The article analyses the case of Rajesh Kumar v. State of Himachal Pradesh, which deals with Sections 302 and 34 of the Indian Penal Code i.e. human mental intent, which forms the foundation of criminology. The author aims to highlight the errors which were made by the court in the case. The article also points out the lack of recourse in the judicial system in cases where the apex court makes an error, which hammer the last nail to the coffin of pervasive ideas of right and proper.
