Big Data Analytics: A Cause of Concern for Competition?

This article examines the impact of big data analytics on competition and evaluates whether existing antitrust frameworks are adequate to address challenges arising from the digital economy. Focusing on data-driven markets, it explains the concept and growing importance of big data and analyzes potential anti-competitive practices such as abuse of dominance, refusal to deal, tying, algorithm-facilitated collusion, and data-centric mergers. The article also critiques arguments that deny the anti-competitive potential of data and reassesses key antitrust concepts like market definition and dominance in the context of big data. It concludes that traditional antitrust tools may be insufficient for regulating data-related conduct and proposes suggestions to assist competition authorities in effectively addressing emerging competition concerns.
