Copyright and Open Access Policy

1. Copyright Ownership

Authors contributing to the NLIU Law Review retain the copyright in their works. However, by submitting and consenting to publication, the author grants the NLIU Law Review an irrevocable, transferable, non-exclusive, perpetual, and worldwide license to publish, reproduce, republish, translate, transmit, sell, distribute, display, archive and otherwise use their submission(s) in electronic and print editions of the Journal and in derivative works in all languages, and in all media now known or later developed.

This license includes an irrevocable non-exclusive right to create and store electronic archival copies of the submission, including the right to deposit the submission in open access repositories. NLIU Law Review also has the right grant others the license to reproduce, republish, transmit, and distribute the submission.

This license is granted for the duration of the subsistence of the copyright including any extensions and/or renewals.

2. Licensing and Permissions

All works published in the NLIU Law Review are made available under the the terms of the Creative Commons Attribution-Non Commercial-No Derivatives 4.0 International (CC BY-NC-ND 4.0) License, provided the original work is cited.

Under this license, any person may:

1. Share, copy and redistribute the material in any medium or format; and

2. Adapt, remix, transform, and build upon the material,

provided that:

1. Appropriate credit is given to the author and to the NLIU Law Review as the original publisher;

2. A link to the license is provided; and

3. The material is not used for commercial purposes.

No additional restrictions may be imposed that legally restrict others from doing anything permitted by the license. For any uses beyond the scope of the CC BY-NC 4.0 License, written permission of the Editorial Board must be obtained.

3. Author Rights and Reuse

Authors retain comprehensive rights to reuse their published work in any manner consistent with the CC BY-NC 4.0 License, provided that the original publication in the NLIU Law Review is properly acknowledged.

Authors may, without prior permission from the Journal:

1. Reproduce the work in whole or in part in any future scholarly work, including books, edited volumes, or anthologies authored or edited by the author;

2. Post the published version or pre-print version on non-commercial personal websites, institutional repositories, or open-access archives;

3. Use the work for educational, instructional, or training purposes, including classroom use and distribution to students; and

4. Share the work with colleagues and peers for academic purposes.

In all such cases, the author must provide the following acknowledgment:

First published in the NLIU Law Review, Volume __, Issue __, Year, under a Creative Commons Attribution–Non Commercial 4.0 International License.

4. Warranties and Author Representations

By submitting a manuscript, the author represents and warrants that:

1. The work is original, authored solely by the submitting author(s), and does not infringe upon any existing copyright or proprietary right;

2. The work has not been previously published, in whole or in part, in any other journal, book, or online platform, unless explicitly disclosed at the time of submission;

3. The work is not under simultaneous consideration by any other publication; and

4. All necessary permissions for the reproduction of third-party copyrighted materials, including figures, tables, charts, or images have been duly obtained.

The author shall indemnify and hold harmless the NLIU Law Review and the National Law Institute University, Bhopal, against any claims or damages arising from breach of the above warranties.

5. Open Access Policy

The NLIU Law Review adheres to the principles of open access publishing. All articles are made freely available online immediately upon publication, without subscription or access fees.

The Journal does not levy any article processing charges, submission fees, or publication fees. Readers are entitled to read, download, copy, distribute, print, and link to the full texts of articles, provided such use is non-commercial and proper attribution is given.

6. Commercial Use and Derivative Works

Any use of the published material for commercial purposes, or any reproduction, adaptation, or republication that falls outside the scope of the CC BY-NC 4.0 License, requires the prior written permission of the Editorial Board of the NLIU Law Review.

Commercial use includes but is not limited to the sale of copies, distribution through commercial databases, or inclusion in products or services for which a fee is charged.

7. Citation Format

All references to works published in the NLIU Law Review must cite the original source in the following format:

Author Name, “Title of the Article,” NLIU Law Review, Vol. __, Issue __ (Year), pp.

8. Reservation of Rights

The NLIU Law Review reserves the right to update or amend this Policy from time to time to align with evolving best practices in open-access publishing, digital archiving, and copyright governance. Any such modifications shall apply prospectively and shall not affect rights previously granted under earlier versions of this policy.

9. Governing Law and Jurisdiction

This Policy and any disputes arising therefrom shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts at Bhopal, Madhya Pradesh.
