This paper seeks to study data exclusivity with particular reference to Indian agro-chemical products. The authors try to define data exclusivity and offeran interpretation of Article 39 of TRIPS agreement in light of data exclusivity to agro-chemical products. The paper examines the Indian position and perspective of data exclusivity by discussing the Satwant Reddy Committee Report. The author also highlights the debate pertaining to IP protection and agrochemicals in Indian scenario. The article also discusses the recent developments in India and around the globe in data exclusivity and agricultural chemicals.
