The Judicial Accountability Bill: A Watchdog for a Watchdog?

ABSTRACT

The Judiciary is one of the three most important organs in a constitutional democracy such as India. The judiciary must be accountable and impartial to the citizens of India to ensure the faultless disposal of disputes. The article argues for public accountability of the judiciary as it is a public institution. The article goes on to analyse the system of the collegium that is being employed for the recruitment of judges of the higher judiciary as well as the wide administrative powers that are granted to the Chief Justice of India, in addition to the judicial powers. The article also puts across that the efficiency of the Chief Justice of India is dampened because of the short tenure of the office that he/she holds. The article analyses the process of impeachment and transfer of judges. Finally, the article puts across solutions for the road ahead.
